IMPORTANT: This section provides the required language and implementation specifications for the “Click Here to Accept” consent mechanism required by payment processors and e-commerce compliance standards. This must be implemented on the BREEDTECH website at registration and checkout.

1. Where Consent Must Be Captured

The consent mechanism must be present and functional at the following touchpoints on the BREEDTECH website:

(a) Account Registration Page: Before a new account can be created.

(b) Checkout / Payment Page: Before any payment can be processed. This is mandatory for payment processor compliance.

(c) Newsletter Subscription: Before any marketing email subscription is confirmed.

2. Required Checkbox Language (Checkout)

Recommended checkbox text: “I have read, understood, and agree to BREEDTECH’s Terms of Service, Privacy Policy, and Refund Policy. I understand that all sales of seeds and genetic materials are final as described in the Refund Policy.”

3. Technical Requirements

The consent mechanism must meet the following technical and legal standards:

(a) The checkbox must NOT be pre-checked. The customer must actively click/tap to accept.

(b) The “Place Order” or “Complete Purchase” button must be disabled or grayed out until the checkbox is selected.

(c) Each policy name (Terms of Service, Privacy Policy, Refund Policy) must be a clickable hyperlink that opens the full policy text in a new tab or modal window, so the customer can review it before accepting.

(d) Upon acceptance, the system must log and store: the customer’s IP address, the timestamp (date and time in UTC), the specific policy versions accepted, the user’s account ID or email, and the page URL where consent was given.

(e) Consent logs must be retained for a minimum of seven (7) years and must be retrievable for dispute resolution and chargeback defense.

(f) The consent mechanism must be clearly visible and not hidden in fine print, collapsed sections, or below the fold.

4. Alternative: “Click Here to Accept” Button

As an alternative to a checkbox, BREEDTECH may implement a dedicated “Click Here to Accept” button that appears above or alongside the payment button. This button must clearly state what is being accepted, must not be ambiguous, and must link to all relevant policies. The same logging requirements apply.

5. Registration Page Consent

Recommended registration text: “By creating an account, I confirm that I am at least 21 years of age and agree to BREEDTECH’s Terms of Service and Privacy Policy.”

6. Payment Processor Compliance Notes

Major payment processors (Stripe, PayPal, Square, Shopify Payments) require that merchants clearly disclose their refund/return policy to cardholders before a transaction is completed. Failure to do so may result in the merchant being held liable for chargebacks filed under “merchandise not as described” or “credit not processed” reason codes. The consent mechanism described in this guide satisfies this requirement by ensuring the cardholder has affirmatively acknowledged the Refund Policy before payment is processed.
